Data Protection Policy

This data protection policy applies to the collection and use of personal data on Elshoppen.dk which is part of Elshoppen ApS and in connection with purchases and other inquiries in Elshoppen ApS. Among other things, it contains information about what personal data is collected, what it is used for and what rights you have.

Elshoppenpen ApS, CVR-nr:40088067, (“Elshoppen ApS” or “we”) is responsible for the treatment and can be contacted in case of questions. The Data Protection Officer at Elshoppen ApS can be contacted at: kontakt@elshoppen.dk.

1. What type of information do we collect and why
Below is an overview of what personal data we collect about you and its purpose. We have also described what, in our opinion, constitutes the legal basis in the various situations:

When purchasing one of our products, we register your name, phone number, payment information, the type of item or service you purchase and when, as well as any information about delivery. If the item is to be shipped to you, we also register the delivery address. In addition, we will also be able to process return information.

The purpose of recording the information is to fulfill and manage our agreement with you and follow up on the sale internally within the organization. The basis for our processing of the data is the agreement with you, cf. Article 6(b) of the GENERAL DATA PROTECTION REGULATION or “GDPR”). In addition, part of the processing is based on our legitimate need to be able to manage the sale in an appropriate manner, cf. GDPR Article 6(f), and we have assessed that this interest outweighs the disadvantage for you.

Managing Sales When buying products in the store, we use also your name or phone number as identification in connection with the payment at checkout and internal settlement to employees and Suppliers. The treatment is based on our legitimate need to be able to manage the sale and the company in an appropriate manner, in accordance with Article 11(1) of Regulation (EC) No 1049/ GDPR article 6(f) and we have assessed that this interest weighs heavier than the disadvantage for you.
Complaints and repairs: If you advertisements about an item or asks us to make a repair, has we need contact information in order to register the complaint and carry out the repair with related service status information, service history and any upgrades, as well as to keep you Updated.
The treatment is necessary in order for us to meet our obligations in the agreement with you, cf. GDPR Article 6(b). some manufacturers also require you to be identified in order for them to approve or perform the repair yourself. In these cases, we will be processor for the manufacturer. customer service
Depending on what the inquiry is about and how you contact us, we need to know who you are, what product you purchased and your address or phone number. We process the information obtained about e.g. name, purchase history and contact information (email, phone number) so that we can help you. Depending on the nature of the request, the basis for our processing of the information is the agreement with you, cf. GDPR Article 6(b) or our legitimate interest in being able to handle your inquiry in an appropriate manner, cf. GDPR Article 6(f). If the basis for the processing is justified by the latter, we have assessed that we have a legitimate interest in processing your personal data so that we can answer your questions in the best possible way, and that this interest outweighs the disadvantage for you when you contact us and ask for this service.
The collection of information using cookies is described below in Chapter 5.

Establishing customer profile: We will be able to form a customer profile based on purchase history and available information for the purpose of broadcasting newsletters, product information, tailored marketing and purchase analysis. The processing is based on our legitimate interest in manage your information for the purpose of sending out newsletters, production information, tailor-made marketing, etc., cf. GDPR Article 6(f). and we have assessed that this interest weighs heavier than the disadvantage for you.

However, if the processing requires your express consent, cf. GDPR Article 6(a), processing of your data will not take place, unless you have consented to do so. See below in the electronic marketing and market research and promotions.

Customer account management: We have access to your customer account, so we manage your contact information and any consents to receive our newsletters, participate in promotions or the like that you consent. At the same time, as we have a duty to ensure that your information is correct, we also receive information from third parties for the purpose of updating the name information address and phone number you have provided. We have assessed that we have a legitimate interest in making contact with you more efficient and manage your contact information through a customer account, cf. GDPR article 6,f) and that this interest outweighs the disadvantage for you, especially as this also allows you to contact us in an easy way and to manage your contact information with us yourself.

Custom online information: At Elshoppen ApS wants to provide our customers with the best possible marketing and relevant information. Thus, if you are logged into your customer account, where you are identified by email address, name, address and purchase history, we use the information from the customer account to tailor content to you that reflects your purchase history and to provide you with relevant product recommendations across the devices you are logged in to. If you are not logged in, we will only use the information stored in the cookie you have accepted in your browser. You can delete cookies in your browser yourself if you wish. The basis for the processing is your consent, cf. GDPR Article 6(a).
In the case of direct marketing by e-mail and sms etc., you will only receive these if we have obtained your consent, cf. GDPR Article 6(a).

Direct Marketing – Marketing Campaigns. The information we collect about you may be based on probability calculation, such as likely size of your household and age. You will only receive marketing based on this profile. You will only receive direct marketing if you have consented to this, see GDPR Article 6(a).
electronic marketing: We only use your personal data to send you offers and information about our products, if you have provided your explicit consent to this, see GDPR Article 6(a). In this context, we use information about your previous purchases to provide you with offers that we think will interest you. You can drag your consent back by contacting customer service or going under consent management on “My Page”.
Market research and campaigns: Only if you have given your explicit consent to participate in a survey, campaign or similar on the Website, we store personal data such as name, address and/or phone number, gender, date of birth, interests, etc. depending on what is requested in each campaign or user survey. Basis for the processing is your consent, cf. GDPR Article 6(a).
Development services and safe operation: In order to further develop our services and operate the Website in a good and responsible manner, we are among others. dependent on being able to use statistics such as traffic, purchases and behaviour on the Web page. We may also need to uncover fraud and take measures to prevent this. In this context, we would like to see some use personal data to test our systems. We will use aggregated data for these purposes as far as possible.
We have that we have a legitimate interest in further developing our services and ensure operations, as referred to in Article 6(f) of the GDPR, and that the limited processing of your personal data that we make in the connection outweighs the disadvantage for you as a user.

2. Who will have access to your personal data?
In some cases, other companies will have access to your personal data:

Collaborators: We have partnered with selected companies (“Collaborators”) and allowed them to sell their own products on the Website, and in some cases we provide the partners’ products and services (e.g. insurance or financing). If you purchase a product supplied by one of our business partners, the business partner will be the data controller for the personal data processed to fulfill the purchase agreement. In relation to our partners, we act as a service provider (“Data Processor”). Questions regarding the processing of personal data by the partners should be addressed to the relevant partner.
Use of external suppliers:If you order external services, the supplier of contact information and other relevant information that we have registered about you may be provided.

Public authority, etc.: Your personal data may in special cases be handed over to relevant public authorities or other institutions if this is a requirement under applicable law.

3. Access from abroad
if Elshoppen If APS makes use of subcontractors outside the EU/EEA, we ensure that the treatment is subject to the same protection as applies within the EU/EEA, for example where the EU Commission has established that the country has an adequate level of protection, where necessary guarantees have been provided or where EU standard agreements, the EU-US Privacy Shield scheme or another equivalent scheme are applied.

4. Use of cookies, etc.
We make use of so-called cookies to give our users a better experience on the Website. A cookie is a text file that is stored in your browser when you visit or move around on a web page.

You can choose not to place such cookies in your browser. they browsers (Google Chrome, Firefox, Internet Explorer, Safari, Opera, etc.) is set up to automatically accept cookies, but you can change the settings so that cookies are not accepted. The downside of disable cookies in the browser is that the Web page will then not work Optimal. This is because the purpose of most of our cookies is to ensure the functionality of the Web page, such as remembering what you have added to the shopping cart.

We also use tools other than cookies to download information about your IP address, what type of browser you are using, your broadband provider, operating system, date and time of your visit to The Web page, as well as information about how to navigate the page.

We use this information to analyze trends so that we can make the Web page more user-friendly.

5. Deletion
Your personal data is linked to your purchases and will normally be deleted when it is no longer needed to respond to your inquiries and the complaint deadline for the product has expired, unless we need to store the information for an extended period of time to meet other legitimate or legal requirements, such as in accounting law.

Personal data that we process on the basis of your consent will be deleted if you withdraw your consent.

Instead of deleting the personal data, in some cases it may be be appropriate to anonymise them. Anonymization means deletion of all identifying or potentially identifying characteristics from the dataset being processed.

6. Your rights
Here you can see your rights, which you can claim at any time by contacting us at the information below:

Withdrawal of consent: If you have consented to receive inquiries from us with offers for goods and services, you may withdraw this consent at any time. We have made it easy for you to turn down such offers every time you receive a request from us. Consent can also be withdrawn by contacting customer service.

Request for insight
You have the right to gain insight into what personal data we have registered about you.
Request for rectification or deletion
You may also ask us to correct incorrect information about you or delete the personal data completely. As far as possible, we will comply with a request for the deletion of personal data, but we cannot do so if there are compelling reasons not to delete it, such as requiring us to keep the data for documentation purposes. You can delete a lot of information yourself. For example, you can delete your profile with us at any time.

Data portability
You can request data portability, including for personal data provided with your consent or that has been necessary for the conclusion of the purchase agreement.
To exercise your rights, you can contact our customer centre. Your inquiry will be answered as soon as possible and no later than within 30 days.
We ask that you verify your identity or provide additional information before you can enforce your rights against us. We do this to make sure that we only provide access to the personal data for you – and not for someone who simply pretends to be you.
Complaint to the Supervisory Authority: If you disagree with the way we process your personal data, you can submit a complaint to the Danish Data Protection Agency. You can find more information about your right of appeal on the Danish Data Protection Agency’s website: www.datatilsynet.dk.

7. Changes
We may make changes to this data protection policy, for example as a result of changes in the structure or functionality of the Website. If there are significant changes, we will inform you on the Website.
